This Privacy Policy describes how Monyxa Ltd (hereinafter – the Company) collects and uses information through its site https://monyxa.com/ or any other sites operated by the Company. The Company is committed to safeguarding any information it collects, uses and holds about its clients. The Company recommends to get acquainted with the Policy before sign-up in the Trader’s Room. If the Client has any enquiries regarding the Privacy Policy, they can get into touch with the Company using the contacts on the Company website.

1.           THE CLIENTS’ PERSONAL DATA

  • In order to open an account with the Company, the Client completes and submits an application form. While the registration process the Client agrees to provide their personal data and copies of verifying documents.
  • The personal data provided by the Client may include:
    • Personal information provided in applications and other forms: name, surname, address date of birth, passport details, occupation, position;
    • Financial information, i.e., investment experience of the Client;
    • Identification documents: scanned copies of passport, utility bill, bank reference;
    • Payment documents: transfer orders, bank statements, copies of credit/debit card, screenshots etc.
    • Credit/debit card details (when depositing/withdrawing funds via credit/debit card)

1.3   The Company requests the personal information in order to identify and verify the Client and to comply with the relevant rules and regulations. This information may also be used by the Company to inform the Client regarding its service.

1.4   The Company asks the individuals under the age of 18 years to opt out of the registration and using provided by the Company service. The Company deems the privacy of the underage to be of great importance and thus does not collect the information on the individuals under the age of 18 years.

  • Allow you to manage and review your marketing choices at any time.

2.         INFORMATION COLLECTED FROM THE CLIENTS USE OF SERVICES

2.1             Tracking systems used on the Company’s website(s) may collect additional Client’s data in order to optimize the services provided there for clients. This data may include information about the Client’s device, log information, location information, cookies.  

2.2           By receiving this information, the Company can provide the Client with the most appropriate version of the website(s), to track user action and therefore troubleshoot any issues that may occur, improve the performance of the website(s), improve the future advertising campaigns. 

3.         CONFIDENTIALITY OF THE CLIENT’S PERSONAL DATA

  • The Company shall not disclose to a third party any of its clients’ confidential information unless:

  • it is required to do so by a regulatory authority of a competent jurisdiction. In such circumstances, the Company undertakes to officially inform the third party about the confidential nature of the information.

  • conveyance of the information to third parties is carried out for the sole purpose of processing the Client’s trading and non-trading instructions. In this case the third parties may be associated or affiliated companies, auditors, agents (including payment agents),
  • banks or other authorized organizations or persons.
  • In the case when the Client’s personal data are collected for some third party which is not the Company’s contractor/service provider, the Company undertakes to notify the Client about it, so that the Client can make a well-founded decision about whether, or not, they agree to share their information with that party.

    4.         COOKIES

  • A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. The Company uses cookies on its site(s). The Company does not link the information stored in cookies to any personally identifiable information the Clients may submit. The Company uses both session ID cookies and persistent cookies. A session ID cookie remains valid after the Client close browser. Persistent cookies are stored on hard drive for an extended period. Following the instructions in the help file of Internet browser, the Client can remove permanent cookies. The Company’s website uses permanent cookies for statistical purposes. The use of persistent cookies also allows the Company to track and identify the location and the interests of users visiting the Company’s site (s) and improve the quality of their services.

  • Several partners of the Company use cookies on the site (s) of the Company; the Company does not have access to such cookies, and does not control them.

    5.         SAFETY AND PROTECTION OF THE CLIENT’S PERSONAL INFORMATION

  • The personal information that the Client provides when registering as a user of the site(s) or the services is classified as Registered information. Registered information is protected in many ways. The Client can access the Registered information by means of the password selected by the Client during the registration. This password is encrypted and known only to the Client. The Client should not share the password with anyone. The Registered information is safely stored on secure servers accessible only to authorized personnel via a password. Besides, in order to secure the personal information, the Company may use SSL-certificate.

  • The personal information provided to the Company which does not qualify as Registered information, also resides on secure servers and is also accessible only to authorized personnel via password. The Client has no access to this information; therefore, the Client will not receive the password allowing to modify it.

6.         CREDIT/DEBIT CARD DATA SAFETY

  • The Client’s received confidential data is processed in processing centre. The Client’s credit/debit card details are not stored in the payment system after the moment of transaction made via the card.

    7.          CHANGES IN THE PERSONAL INFORMATION

 In case of any changes in the personal information the Client should inform the Company using the contacts on the website.

8.         CONTENT OF EXTERNAL SITES

  • The Company’s website may include links to external websites that the Company does not have influence over, thus the Company is not responsible for their content. It is the provider of the website or of the information who is responsible for the external sites content.

9.         LEGAL DISCLAIMER

  • The Company reserves the right to disclose your personally identifiable information as required by rules and regulations, and when the Company considers that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served.

  • The Company will not be liable for any misuse or loss of personal information resulting from the use of cookies on the Company’s website(s) that the Company does not have access to or control over.

  • The Company shall not be liable for unlawful or unauthorized use of your personal information due to misuse or misplacement of your passwords, negligence or malicious actions.

    • to carry out our obligations arising from any transactions you enter into with us, for example deposits, withdrawals and Monyxa Card Purchases and to provide you with the information, products and services that you request from us;
    • to provide you with information about other goods and services we offer that are similar to those that you have already purchased or enquired about;
    • to provide you, or permit selected third parties to provide you with information about goods or services we feel may interest you. Please see the section on ‘Third Party Services’ below for more information; to verify your identity to protect against fraud, comply with financial crime laws and to confirm your eligibility to use our products and services; to notify you about changes to our service; to ensure that content from our site is presented in the most effective manner for you and for your computer.

    • We may associate any category of information with any other category of information and will treat the combined information as personal data in accordance with this policy for as long as it is combined.
    • For example, we may use credit reference agencies to carry out name and address searches on you, so that, when you apply for products or when we suggest products to you, we will be able to tailor our offering to your needs. The use of credit reference agencies and fraud prevention agencies is not limited to such agencies based in the United States and includes such agencies overseas. Any such search under this section will not leave a footprint on your credit file. You acknowledge that we may carry out such credit search in the knowledge that it will not leave a footprint on your credit history. In certain circumstances, you are entitled to access your personal records held by credit and fraud prevention agencies. If you would like details of the credit reference and fraud prevention agencies from which we have obtained or may obtain information about you, please contact our support team.
    • If we decide to engage advertisers to promote our products and services, the advertisers and their advertising networks may require anonymized personal data to serve relevant adverts to you and others. We will never disclose identifiable information about individuals to advertisers, but we may provide them with aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisements on any given day). We may also use such aggregate information to help our advertising partners provide a tailored and targeted campaign, relevant for a subsection of our users. In some instances, we may use personal data we have collected from you to enable our advertising partners to display their advertisement to their target audience.
    • We have set out below, in a table format, a description of all the ways we use your personal data as stated above, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.

  •  MARKETING
    • We want to make it crystal clear how we use your data for marketing purposes and how you can ‘opt-out’ from receiving any marketing communications from us whenever you want.
    • We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising. If you receive any marketing related communications such as email and wish to end your subscription, follow the unsubscribe links on any marketing message sent to you.
    • We may use your personal data (such as your Submitted Information, Location Information or transaction information) to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you.
  • You will receive marketing communications from us if you have signed up to and/or utilise the Monyxa Services and, in each case, you have not opted out of receiving marketing notifications.

  • We will obtain your express opt-in consent before we share your personal data with any company outside the Monyxa group of companies for marketing or promotional purposes.

  • You can ask us or third parties to stop sending you marketing messages at any time by adjusting your marketing preferences by following the unsubscribe links on any marketing message sent to you.

    12         DISCLOSURE OF YOUR INFORMATION

  • We will disclose the data we collect from you to certain third parties who use personal data in delivering their services to us, they use data securely and confidentially and under strict contractual controls in accordance with data protection laws and enforced by Monyxa.
  • We send personal data to the following sets of data processors in order to perform the Monyxa Services:
  • This is in order to verify your identity, protect against fraud, comply with anti-money laundering laws and to confirm your eligibility to use our products and services;
  • This is in order to safely and securely store your data with Monyxa;
  • Banking and financial services partners
  • Financial services providers that help us provide the Monyxa Services including banking partners, banking intermediaries and international payments services providers;
  • For the purpose of verifying your personal details. Please see section 4.3 above for more information;
  • For the purpose of creating your personalized Monyxa card and delivering this to you at your requested address;
  • If we decide to engage advertisers to promote our products and services, the advertisers and their advertising networks may require anonymized personal data to serve relevant adverts to you and others.   • Companies within the Monyxa group
  • In order to provide a unified service across all of our products and services, we may disclose your personal information to any member of the Monyxa group, which means any of our subsidiaries or related entities.
    • We may also disclose your personal information in the following circumstances:
  • If Monyxa or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request.
  • In order to:
  • enforce or apply the General Terms of Service and/or the Business Terms and/or any other agreements between you and us or to investigate potential breaches; or
  • protect the rights, property or safety of Monyxa, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
    • We may share your data in order to provide certain services to you upon your request. For example, we will share your data with our credit referencing agency partners so that they may verify details you provided us when you submitted the application or card processor, in order to process card/wallet transactions. Your data will only be sent across in these instances once you have requested to utilize financial services. You can withdraw your consent at any time by contacting support team, however, please be aware that this may impact your ability to use such services going forward. Please remember that when we share your data with our partners in such instances that you will also be subject to our partner’s privacy policy as well.
  • From time-to-time, we may partner with certain third parties in order to offer you co-branded services or promotional offers. In order to provide these services to you and to allow us and any associated third party to optimize their/our offering to you, we will share some of your personal data with such third parties. We will obtain your express opt-in consent before we share your personal data with any company outside the Monyxa group of companies for these purposes.

  • You can withdraw your consent at any time after giving your explicit opt-in consent by contacting support team and letting us know.

    13        INTRODUCING CHANGES TO THE PRIVACY POLICY

  • When the Company decides to make changes to the Privacy Policy, the Company will introduce such changes in this privacy statement, on the website and other places where the Company deems appropriate, so that the Client is aware of what information the Company collects, how the Company uses it and under what circumstances, if any, discloses it. The Company reserves the right to modify this Privacy Policy at any time, so please re-read it regularly. In the event of substantial changes to this policy, the Company will notify the Client by email or on the website. If the Client continues to use the website services or visits it, they agree automatically with changes introduced to the Policy.
